According to “The Indian Trust Act, 1882”, a trust is an obligation annexed to the ownership of property and arising out of a confidence reposed in and accepted by the owner, or declared and accepted by him, for the benefit of another, or of another and the owner.

  • A trust must be created for any lawful purpose.
  • The subject matter must be property transferable to beneficiary instead of merely giving beneficial interest.
  • Every person who is eligible to make contracts can create a trust with the permission of principal civil courts or original jurisdiction.

Society/ NGO

In accordance with “The Societies Registration Act, 1860,” a society or NGO is an organization comprising a collective of individuals joined together for a shared objective, which may include the advancement of science, literature, fine arts, social welfare, and societal development. Typically, societies are established to promote charitable endeavors, such as education, art, and culture, with a focus on non-financial gain.
